No, if I fight the ticket, and loose, then I also loose the opportunity for traffic school, which means I get a 3rd point for the ticket.

Here is the break down:

At fault accident= 1point
Injury due to accident= 1point
Traffic violation= 1point

If I pay the traffic violation, and go to traffic school, I can avoid the 1point for the ticket. But thanks to this asswipe and his so called injury (my *** he is injured) I will get 2 points for the accident vs. 1 point for just a simple accident!

he's claiming injury?? from a low impact rear end collision??? oh man...i smell f-r-a-u-d....

This is just sad, i can't believe what people can do to one another sometimes...

this even furthers my ill opinion of insurance agency's, the mere fact that they want to settle out of court just proves to me that have no interest in justice, only their bottom line.

Your agency stands to make more money from your premiums, then they would loose on the settlement,so why would they fight the claim?

Your ONLY chance is to fight the ticket, but i understand if you don't want to take the risk...

I'm sorry Mike. This world is just full of stupid idiots and it shows. I remember reading when it first happened how this sounds JUST like an insurance fraud case... people cutting off and slamming on the brakes and such.. and then claiming injury.

Looks like that is sadly coming true

I agree with everyone...Even though the insurance claims they are there for me, its bullsh*t, whatever is best for them...The guy I hit, he's full of sh*t, just looking for a quick buck. Who gets screwed in the end? ME! But really there is not a whole lot I can do, except as mentioned fight the traffic ticket, which means I risk getting the 3rd point, and paying an additional few thousand per year for insurance...So as much as it sucks to pay for a ticket I truly don't think I deserved, a one time fee of $300ish, and traffic school to keep it off my record is WAY cheaper than paying say and extra 1500-2000 per year for the next 3 years if I did get the third point. 2 points on my record is enough for me!

Mike, that really sucks! I'm behind you 100% on this. That guy obviously scoped out someone with a nice car, with the intention of filing an insurance scam. An injury that is damn near impossible to disprove. This is not a coincidence.

That would be a negative! He never said why, just that he had to...hmmm! The cop even asked him, and he said because I had to so I would not hit the car infront of me...the cop then asked, so did the car infront of you slam on the brakes too? He said no...So if the car infront of him did not slam on the brakes why did he??? Was he following to closely???? And i'm the one that gets a ticket for following to close....BullS*it!
