Should I repeal Hunters points penalty?
I remind everyone that before we just start jumping on ol' Hunter, to remember what you would think if you were in his shoes.
I first present the rule as stated in NASCAR Fantasy.
6) Any penalties that any of your picks earn points wise for the entire year will also be taken away from your own points. This includes any comments made by your driver that end up in points deductions, such as when Jr. cursed in victory lane and was docked points, or any points deductions due to illegal parts on your choices car, such as when Clint Bowyer was docked 150 points at New Hampshire in 2010. Any penalty involving probation or money only will not result in any points loss.
To read this rule strictly, Hunter just lost points. But this rules infraction given to Jimmie Johnson was given for a piece on the car before qualifying ever happened. So if I am to be really strict, anyone who chose Johnson should lose points for the duels as well. The points penalty was assessed, however, despite what I feel was a bad call by NASCAR.
I really think I have to gather a points penalty here. I was asked earlier... if I ahd Johnson, what would I do? Well, I try to actually be more strict on myself than tohers since I'm leading this thing.

Well as His dad, I am not taking his side. But, I think its a crappy penalty to incur when it was something that happened and was corrected before the race. I lost points along with someone else last year due to a Kyle Issue but is was race related. This penalty just seems unfair. Can't we police ourselves when it come to stuff like this. TAKE A POLL if and when an issue arises and no one will be hurt. Fair is fair.. You all may think 10 pts isn't much but did you see last years chase? Well we weren't that close but going into the last race there were 3 of us with a chance to win it.
I say we let NASCAR's rule stand here. And if Hendricks appeal works (it won't) then that is the ruling. I think we're drifting into dangerous territory if we start trying to judge ourselves. I think it's easier when we straight up make it someone else call - and this won't be my call to make either. It's easy to be at peace with that.
I know I can honestly say if I were in Hunters shoes, I'd want the penalty. I'd feel guilty otherwise, but that just me. If you remember way back before we really started scoring these things I suggested penalties even if the driver you picked for last or first cauton was penalized. It really is part of playing, part of the fun. If Hunter can pull out a Championship, thems are even bigger braggin' rights!
If we overturn this, sooner or later something else will be unfair if it's not overturned. And then it's Duane's reputation. Let's leave it in the incapable hands of NASCAR.

It is dangerous territory. Then we're as bad as NASCAR when we don't enforce rules that were made by NASCAR.
I just edited the the race thread. I had knocked Hunter back 25 points in the stats thread, but not the Phoenix thread. He had actually been scored too well anyway, for some reason I had given him 5 points for the 48. He should have received 2.

I talked to Hunter and He said he would be good with it being deducted. everyone has good positions that they pointed out. So let's just stick with Nascrap on what they do if you want. That way we never have an issue.
I'm having a hard time right now trying to decide on one or the other. If I really had to make a call I'd say leave it the way it is. It looks like overall we're swaying more towards leaving it the way it is. I think that's best for staying away from trying to decide what's a penalty and what's not on here. Either way, I'm okay with whatever we decide.
Vote is 50/50 right now... and I don't want to revise rules mid season. It is better to stick with NASCAR, despite inconsistencies, because as Brent ahs pointed out, and I agree with Brent for the 5th time this year, it is better to let all penalties take affect, lest we get into arguments over which penalties stand and which ones do not. By over turning this penalty, we set a bad precedence.
