how ridiculous.... i would appeal it to the supreme court if i could (incase some of you can't tell, i'm a huge fan of the first amendment)

It really is a tough call regarding the 1st Amendment. I can the seperation of the government, but the state does own the plates and can dictate what gets printed.
My problem is they "probably" aren't doing it to be jerks with offensive plates since it is their last name, but they could be using it to their advantage as well.
