OFFICIAL RULES

PROMOTION DESCRIPTION: The JEGS® “WIN THIS CAR! CELEBRATING 50 YEARS” Sweepstakes (the “Sweepstakes”) begins February 15, 2010 at 12:01 a.m. Eastern Time (“ET”) and ends July 4, 2010 at 11:59 p.m. ET (the “Promotion Period”), with the winning entry to be randomly selected on July 12, 2010. Entry in the Sweepstakes does not constitute entry into any other promotion, contest, or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of JEGS Automotive, Inc., 101 JEGS Place, Delaware, OH 43015 (“Sponsor”), which shall be final and binding in all respects. JEGS® and the JEGS logo are registered trademarks of JEGS Automotive, Inc. and may not be used without prior express written permission.
ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia. Void in all states where prohibited by law. All entrants must be 18 years of age or older as of February 15, 2010. Sponsor and its parent, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their respective officers, directors and employees and the immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win the prize.
HOW TO ENTER:
Eligible persons wishing to participate in the Sweepstakes may enter the Sweepstakes by visiting the web site at www.JEGS.com (the “Website”) and completing the electronic entry form. Alternatively, eligible persons wishing to enter the Sweepstakes may do so by sending a 3” x 5” index card with the entrant’s name, address, city and state, zip code and phone number. Mailed entries must be mailed to: The JEGS “WIN THIS CAR! CELEBRATING 50 YEARS” Sweepstakes, c/o JEGS Automotive, Inc., 101 JEGS Place, Delaware, OH 43015. One method of entry does not increase a participant’s chances of winning over another method of entry.
Regardless of method of entry, participation is limited to ONE ENTRY PER HOUSEHOLD. Sponsor is not responsible for entries not received. All entries become the property of the Sponsor and will not be acknowledged or returned. All requested information for the mailed entries and all information requested on the entry form at the Website and indicated as required must be included to enter and to be eligible to win. Information collected in the online entry process may be used to contact you regarding future JEGS promotions. Incomplete entries will be disqualified. Proof of entering information at the Website or of a postmark date is not considered proof of delivery to or receipt by Sponsor of such entry. Except as contemplated in these Official Rules, personal information collected through the Website in connection with this Sweepstakes will be used in accordance with the privacy policy found on the Website.
All entries must be received (either by the Website or by JEGS in the mail) during the Promotion Period in order to participate. The Website’s database clock will be the official time keeper for entries in this Sweepstakes. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the effected entry will be deemed ineligible. Sponsor shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. Sponsor assumes no responsibility or liability for any error, omission, interruption, deletion, theft, or destruction, or unauthorized access to, or alteration of entries. Limit one entry per household and per e-mail address. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified from this Sweepstakes. The use of any device to automate the entry process is prohibited.
WINNER SELECTION AND NOTIFICATION: On July 12, 2010, the prize winner will be randomly selected from all eligible entries received during the Promotion Period. The potential prize winner will be notified by telephone and/or mail, using contact information provided or collected at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted, or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may forfeit, at Sponsor’s sole discretion, his or her prize and an alternate winner may be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected. The odds of winning depend on the number of eligible entries received.
PRIZE/APPROXIMATE RETAIL VALUE (“ARV”) in U.S. DOLLARS: One (1) prize will be awarded—the winner’s choice of one of either a 2010 Chevrolet Camaro SS with an ARV of $35,000, or $20,000.
CONDITIONS ON PRIZE: The Camaro will most likely be in the color scheme of yellow with black stripes, but color scheme is subject to change and, along with package, factory options, and other prize specifics, is in Sponsor’s sole discretion. The Camaro odometer will reflect mileage gained during travel in promotion of this Sweepstakes and other incidental mileage. Winner must have proof of a valid U.S. driver’s license from winner’s state or place of residence in the United States to take possession of vehicle. The winner will be responsible for retrieving the prize from the Sponsor’s world headquarters in Delaware, Ohio, and for all associated expenses including travel for retrieval of prize, tax, title, license, insurance, registration fees, and any and all other expenses relating to the receipt and use of the prize. Sponsor disclaims and does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including but not limited to its quality, fitness for purpose, or mechanical condition. Sponsor has sole and final discretion and authority in selecting schedule of receipt for selected prize. All other expenses not specified herein or pre-approved by Sponsor are the winner’s sole responsibility. JEGS Automotive, Inc. reserves the right, in its sole and absolute discretion, to substitute a prize of equal or greater value. Prizes are not redeemable for cash.
AFFIDAVIT OF ELIGIBILITY; TAXES: BY ENTERING THE SWEEPSTAKES, PARTICIPANTS UNCONDITIONALLY AGREE TO ACCEPT AND BE BOUND BY ALL TERMS OF THESE OFFICIAL RULES. As a condition to receipt of the prize, except where prohibited by law, the winner of such prize will be required to sign an affidavit of eligibility and release form in favor of JEGS Automotive, Inc., the Sponsor. This document may provide, among other things, that the entrant has complied, and will continue to comply, with all of the sweepstakes rules and that JEGS Automotive, Inc. and its subsidiaries and affiliates may use the winner’s name, likeness, and employment affiliation in advertising and promotional materials without providing any additional compensation to the winner whatsoever. All federal, state, municipal, and local income, and other taxes, maintenance, and operating expenses associated with the operation of the prize to be awarded to the winner, shall be the sole and exclusive responsibility of such winner.
GENERAL CONDITIONS: By participating, entrant agrees to release, discharge, and to hold harmless Sponsor and any affiliated entities and their respective employees, officers, directors, shareholders, parent companies, agents, marketing partners and affiliates, and waive all causes of action relating to any and all injuries, costs, liability, losses, damages, rights, claims and actions of any kind in connection with or resulting from their participation in the Sweepstakes or resulting from the delivery, acceptance and/or subsequent use or misuse of any prize awarded, including without limitation, personal injury, death and property damage, reasonable attorney’s fees, court costs, and claims based on publicity rights, defamation, or invasion of privacy. Sponsor and any parents, subsidiaries, franchisees, participating vendors, distributors, marketing partners, and affiliated entities are not responsible for (i) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (ii) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use, or misuse of a prize, or from participation in Sweepstakes; or (iii) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of Sponsor, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes for any other reason at the sole discretion of Sponsor. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any prize furnished in connection with the Sweepstakes. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF OHIO WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
