Okay,just seeing if I got this straight.
So an owner/team would be like a football player wearing a certain number.
NASCAR would be like the football team (let's say the Lions).
So when #8 on the Lions gets traded to Dallas, he's not guaranteed the same number. Is this basically the same situation Dale Jr. is in?

i was under the impression that the team owned the #, if they wanted to sell it they could, childress wont give up the 3, just like theresa wont give up the 8
if it wasn't that way then jr would be driving the 8 next year

What ever number he eventually gets, should be good for souvenir/merchandise sales. With everybody looking to replace all their #8 stuff with the newnumber.
If he gets #81, I can just write a big "1" in magic marker after the "8"s on my car. (lol)

Taz, you got it right. See, all of hte car owners, evne Teresa Earnhardt, know better than try to field a #3. Heck they would probably recieve death threats if they put anybody but Earnhardt Jr. in that number. Right now, Childress has precedence over the 3, if another team wanted it, they would have to speak with NASCAR and Childress. If Childress decided not to field a car with a 3 on it, then the other team could have the number. Currently, Teresa has precedence over the 8, no Jr. As long as she wants to field a #8, she may.

NASCAR "owns" the car numbers and teams generally keep the same numbers year over year. The rule -- Section 20 - 3.11 -- reads, in part: All NASCAR Nextel Cup Series car numbers are owned by and will be assigned by NASCAR for use by the car owner. Car numbers are not transferable or assignable by the car owner.
"Our hope was to carry the No. 8 with Dale Jr. to his new team, but the last proposal Hendrick Motorsports received from DEI just wasn't viable," said Kelley E. Elledge, vice president and general manager for JR Motorsports.
"It was a difficult decision, but all of us agreed that it was best to move in another direction. There's disappointment, of course, but we look forward to working with Hendrick Motorsports on what will be a great program for Dale Jr. and his fans in 2008."
Earnhardt has driven the No. 8 car since his Cup Series debut on May 30, 1999, at Charlotte. In 277 starts, the third generation driver has 17 wins, 73 top-five finishes and 117 top-10s.
No timetable has been set for an announcement of Earnhardt's car number or team sponsor.
A two-time Busch Series champion, Earnhardt has sported several numbers in that series with an 8 theme -- 87, 8, 81 and, most recently, 88 on July 7 at Daytona.

NASCAR LEASES OR LOANS OR ASSIGNS THE NUMBERS.
The owners have control inside their own teams just like when you lease a car or building.

Who owns the Nextel Cup car numbers?
NASCAR owns and assigns car numbers to an owner(s). NASCAR reserves the right to revoke or transfer car numbers to another owner/team at any time. Car numbers are non-assignable and non-transferable, except by NASCAR. NASCAR works with teams and sponsors when a specific number is requested. If duplication of numbers occur, which usually happens with the part-time teams, the fastest qualifier usually gets to use the number unless one team is considered full-time. In 2002, the #27 was used by Scott Wimmer for Bill Davis Racing and by Kirk Shelmerdine, both part time, however, Wimmer was listed in the #27 and Shelmerdine in the #`172 and when they attempted the same races, Wimmer got to use the #27 and Shelmerdine ran the #72, so NASCAR uses it's judgement in deciding who runs the number.(9-6-1999/9-17/2003)
