Bad news! collision
Well it happened! I got hit. Thankfully, no one was injured, but the Monte got banged up. I was driving in the left lane, and got sideswiped by a lady who assumed that putting your signal light on gives you the right of way to make a lane change. She hit me on the passenger side just in front of the rear wheel. Now my question is this - how do you not see3/4 of a full size car in front of you??? Anyways, I took it to the body shop, and got a free rental out of the deal, and the insurance company waived my deductible ($1000)(phew!!). Now here comes the bad part - the body shop called me the other day, and told me that they could not honour their lifetime warranty on their repairs. Why? You ask? Well, it seems that once they stripped off the paint, they found that there was previous filler underneath! Meaning that the car had been repaired before. Now I was furious - not at the body shop, but at the dealer where I bought the car. I bought the car as a rental return, and was assured by both the salesperson, and the used car manager that the car had not been in any previous accidents. I even went as far as to get a carfax report on the car, and it too came upclean. I've had the car for six months now, and am not sure how to proceed with any recourse in this matter. Should I go after the dealer? If so, what can I do? They obviously wont give me another car, but I feel pretty angry over this whole thing. Any suggestions?

It seems it's always a gamble when you buy a used vehicle, or use rental.
Even with a CarFax report *Not all Dealer's/Shops, report a repair `if
there was no insurance claim or police report. [X(]
I don'tknowyour legal options, but I would talk to an attorney
that has knowledge in contracts.

Monte's can be replaced, you can't.

i'm a hell raiser myself, thats what i'd do... maybe you're the calm and peaceful type.... i don't believe that gets the message across all the time, sometimes thye need a little fear to get the message. i wouldn't wish you're troubles on anybody, and i certainly hope things go well for you from here on out. but theres light in most every situtation i guess, and i suppose waiving the deductiable was the best news you've heard all week. but i agree with you're statement about how does somebody not see a full size car beside them... if they hit it at the passenger door, most of your car was past them, which mean't that your rear bumper was probably even with their drivers door. somebody needs new glasses. i could understand if it was a miata... heck our cars can suck them through the airbox and not even hiccup, but a MONTE CARLO!?!?!??! i hope that person gets the little mark for glasses next time they get their license renewed, or even better, thank God for lasic.

I am just being honest with you about this so please don't take this for any more than it is. If you have the extra money or even if you don't ask the bodyshop if they would remove all the previous filler, re do the work and warranty it then. It will definitely cost more. If they tell you no, you are obviously at the wrong bodyshop to be doing repairs for me on my car. For every good shop there is a bad one. Most of them look for a "easy" way out on thewarranty. I know because Iwork in the industry. As far as legal issues go... if therepair was less than $400 is doesn't have to be reported to Carfax to the best of my knowledge. Good luck with whatever you decide but it will probably end in you getting your car repaired and thats it. The waiver of the deductible is a bonus! The manager and anyone else you talk to will probably say " we are not specialists in identifying previous damage ' in an effort to remove themselves from the issue and leave you somewhat optionless. Perhaps a free tank of gas could be gained! Good luck and keep us posted.
the other thing you need to do is to get the body shop or even better you go and get pictures of this other damage.
I have seen cars that i know have never been hit have filler in them from the factory. So it is not always the case that they were hit on teh street. could be they took them in to the lot and crubeld them up some how and repaird then and sent them out as new.

I know it was never hit also but there is filler in it thanks to the idiots that moved it from Ga. to TX. on a big truck and cant chain down prprely.

Hey man, I'd raise hell if it was me... if you have a small local newspaper and the dealer doesn't give you a good result... write a letter to the editor... I've done this for many a place that has cheated me. Always with either get good results, or the place will be out of business soon enough.... Just don't be name-calling, and for sure don't lie or inflate the truth. Tell it how it is and that you wanted the other good residents of wherever to know.
well, the thing is every single car comes factory from the dealership with body fill in it, depends on the extend, but its always there...no matter what...in EVERY single car has it....but if its a lot then the place you bought it from had something done to it....but what i'm questioning would be the body shop that gave you the lifetime warranty on paint...did they not notice this before?? something fishy there
